Customer-Controlled Data and Responsibilities

For many Services, Tylmen processes video, image, operational, facility, device, and related customer content in connection with customer-controlled farms, poultry houses, processing facilities, production lines, loading areas, equipment areas, and other business locations.

Tylmen’s customers determine the environments in which the Services are deployed and are responsible for:

  • selecting camera and equipment locations;
  • determining camera field of view and monitoring objectives;
  • determining whether cameras are used in farm, poultry-production, processing, equipment, safety, quality-control, or operational areas;
  • designating authorized users and managing user roles, permissions, and access levels;
  • providing workplace, premises, visitor, contractor, employee, union, or other notices where appropriate;
  • obtaining any required consents, acknowledgments, or authorizations;
  • maintaining appropriate policies for use of camera feeds, recordings, alerts, analytics, and reports;
  • ensuring that their use of the Services complies with applicable laws, contracts, workplace policies, labor obligations, food-safety requirements, facility rules, and other legal or operational requirements.

Tylmen processes customer-controlled data in accordance with the applicable customer agreement, customer configuration, and customer instructions, except where otherwise permitted or required by law.

Camera Placement and Incidental Capture

The Services are designed for agricultural, poultry-production, poultry-processing, operational, quality-control, safety-related, and facility-monitoring purposes. They are not designed for the primary purpose of identifying, profiling, or monitoring individual employees, contractors, visitors, inspectors, or other persons.

Depending on customer configuration, individuals may be incidentally captured in live feeds, recordings, images, alerts, or analytics when they are present in monitored areas, including farms, poultry houses, hatcheries, processing facilities, production lines, equipment areas, loading areas, and other customer-controlled environments.

Customers should not place cameras or monitoring equipment in areas where individuals have a heightened expectation of privacy, including restrooms, locker rooms, changing areas, break areas designated as private, medical rooms, private residences, sleeping quarters, or similar locations.

Customers should use appropriate placement practices, signage, notices, access controls, and internal policies for monitored areas.

How We Share and Disclose Information

We may share or disclose information as described in this Privacy Policy, in the applicable customer agreement, at the time information is collected, or as otherwise permitted or required by law.

A. Customers and Authorized Users

We may make video, images, alerts, analytics, reports, dashboards, operational data, and related Service information available to the applicable customer and the customer’s authorized users.

Customers and authorized users may access information associated with their accounts, facilities, cameras, processing lines, poultry houses, equipment, and other monitored environments according to their configured permissions and applicable customer agreement.

B. Service Providers and Vendors

We may disclose information to vendors, contractors, and service providers that perform services for us or on our behalf, including cloud hosting, on-premises deployment support, data storage, software infrastructure, analytics, monitoring, customer support, payment processing, communications, cybersecurity, professional services, and technical operations.

These providers may access information as needed to perform services for Tylmen and are expected to handle such information in accordance with applicable contractual, confidentiality, security, or data protection obligations.

C. Legal, Compliance, and Safety Purposes

We may disclose information where we believe disclosure is necessary or appropriate to comply with applicable law, regulation, subpoena, court order, legal process, governmental request, regulatory request, audit obligation, or similar legal or compliance requirement.

We may also disclose information to enforce our agreements or policies, protect Tylmen’s rights or property, protect the rights, property, or safety of customers, authorized users, farm personnel, facility personnel, animals, visitors, or others, detect or prevent security incidents, investigate suspected fraud or misuse, pursue available remedies, or limit damages.

D. Business Transactions

We may disclose or transfer information in connection with an actual or proposed merger, acquisition, financing, reorganization, bankruptcy, sale of assets, corporate transaction, or other change in ownership or control involving Tylmen or any portion of its business.

E. Aggregated or De-Identified Information

We may use or disclose aggregated, anonymized, or de-identified information for analytics, benchmarking, research, product improvement, operational improvement, business planning, and similar purposes.

We will not attempt to re-identify de-identified information except as permitted by applicable law or contract.

F. With Consent or Direction

We may disclose information with consent, at the direction of the applicable customer or authorized user, or as otherwise described in the applicable customer agreement or Service configuration.

Cookies and Similar Technologies

We may use cookies, pixels, web beacons, server logs, device identifiers, and similar technologies in connection with our websites and online Services.

These technologies may be used to operate and secure the Services, authenticate users, remember user preferences, maintain sessions, understand how users interact with websites and Service features, analyze performance, troubleshoot issues, improve functionality, and support marketing or business-development activities.

Cookies and similar technologies may collect information such as browser type, operating system, device information, IP address, pages or features accessed, referring pages, dates and times of access, and other usage or diagnostic information.

Users may adjust browser settings to refuse or disable certain cookies. If cookies are disabled, some features of the websites or Services may not function properly.

Data Storage and Retention

We may store and process information through a combination of on-premises systems, customer-site equipment, local devices, edge computing infrastructure, cloud-hosted environments, and third-party service providers.

Video, image, operational, device, account, and system data may be stored locally, in the cloud, or in both environments depending on the applicable customer agreement, deployment model, system configuration, storage settings, technical requirements, and applicable law.

We retain information for as long as reasonably necessary to provide the Services, comply with legal and contractual obligations, resolve disputes, troubleshoot systems, maintain business records, enforce agreements, support business operations, and fulfill the purposes described in this Privacy Policy.

Retention periods may vary by customer, facility, camera, system, data type, storage environment, and Service configuration.

When information is no longer required, we may delete, overwrite, de-identify, aggregate, archive, or otherwise handle the information in accordance with applicable retention practices, customer agreements, system settings, and legal requirements.

Data Security

We take security seriously and use administrative, technical, and physical safeguards designed to protect information against unauthorized access, loss, misuse, disclosure, alteration, and destruction.

Depending on the Service, deployment, and customer configuration, these safeguards may include access controls, authentication measures, permission management, encryption, network security measures, system monitoring, logging, backup practices, vendor oversight, secure development practices, and physical protections for on-premises equipment.

Because the Services may involve customer-site equipment, edge devices, on-premises infrastructure, cloud-hosted systems, and third-party service providers, security responsibilities may be shared among Tylmen, the customer, authorized users, and applicable service providers as described in the customer agreement, system documentation, or Service configuration.

No method of transmission, processing, or storage is completely secure. We cannot guarantee the absolute security of information transmitted to, stored by, or processed through the Services.

Customers and authorized users are responsible for maintaining the confidentiality of credentials, protecting customer facilities and equipment, and using the Services in accordance with applicable security instructions, agreements, and policies.

Access Controls

Access to customer accounts, camera feeds, recordings, dashboards, alerts, analytics, reports, operational data, and related Service information is intended to be limited to authorized users, Tylmen personnel, and service providers with a legitimate need to access such information for the purposes described in this Privacy Policy or the applicable customer agreement.

Customers are responsible for designating authorized users, assigning roles, managing permissions, reviewing account access, and removing access when it is no longer appropriate.

Tylmen personnel and service providers may access customer information where reasonably necessary to provide, maintain, support, troubleshoot, secure, or improve the Services, or as otherwise permitted by the applicable customer agreement.

International Data Transfers

Tylmen is based in the United States, and information may be processed, stored, or accessed in the United States and in other jurisdictions where Tylmen or its service providers operate.

If information is transferred across borders, we will use safeguards required by applicable law where such safeguards are required.

Laws in the jurisdictions where information is processed or stored may differ from the laws of the jurisdiction where the information was originally collected.

Your Privacy Choices and Rights

Depending on your location and applicable law, you may have the right to request access to, correction of, deletion of, or portability of personal information about you, or to object to or restrict certain processing of personal information.

To submit a privacy request, contact us at service@tylmen.com. We may request information reasonably necessary to verify your identity, confirm your authority to act on behalf of another person or organization, and locate the information relevant to your request.

Because many of the Services are provided to business customers in customer-controlled environments, certain information may be controlled by the applicable customer rather than Tylmen. If your request relates to information controlled by one of our customers, we may direct you to that customer, notify the customer of your request, or process the request in accordance with the customer’s instructions and applicable law.

We will respond to privacy requests as required by applicable law. We may decline a request where permitted by law, including where we are required or permitted to retain information for legal, security, contractual, operational, or compliance purposes.

Marketing Communications

We may send business, product, service, and promotional communications to customers, prospective customers, authorized users, and other business contacts.

Recipients may opt out of marketing emails by using the unsubscribe mechanism included in the email or by contacting us at service@tylmen.com.

Even if you opt out of marketing communications, we may continue to send non-marketing communications, including service announcements, security notices, transactional messages, support communications, account notices, and other communications relating to your use of the Services.

Children’s Privacy

The Services are intended for business, agricultural, poultry-production, and poultry-processing use and are not directed to children under 13. Tylmen does not knowingly collect personal information directly from children under 13 through the Services.

If we learn that we have collected personal information directly from a child under 13 without appropriate consent, we will take reasonable steps to delete that information or otherwise handle it as required by applicable law.

California Privacy Notice

This section applies to California residents to the extent the California Consumer Privacy Act, as amended, applies to Tylmen.

We may collect the categories of personal information described in this Privacy Policy, including identifiers, business contact information, internet or network activity information, location-related information, visual information, audio information if enabled and permitted, professional or employment-related information, and inferences or analytics derived from use of the Services.

We use these categories of personal information for the business and commercial purposes described in this Privacy Policy, including providing and improving the Services, supporting customers and authorized users, maintaining security, performing analytics, communicating about our business, and complying with legal or contractual obligations.

We may disclose personal information to customers, authorized users, service providers, vendors, contractors, business partners, legal or regulatory authorities, parties involved in business transactions, and other parties as described in this Privacy Policy.

Tylmen does not sell personal information or share personal information for cross-context behavioral advertising as those terms are defined under California law.

California residents may have rights to request access, correction, deletion, and information about Tylmen’s privacy practices, and to be free from discrimination for exercising privacy rights.

To submit a California privacy request, contact us at service@tylmen.com.

Third-Party Services

The Services may contain links to, or integrations with, third-party websites, platforms, applications, tools, or services. A link or integration does not mean that Tylmen controls or endorses the third-party service or its privacy practices. If you access or use a third-party service, that service’s own privacy policy and terms govern its collection, use, and disclosure of information.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make changes, we will update the Effective Date above and may provide additional notice where appropriate or required.

The updated Privacy Policy will apply as of its stated effective date. Continued use of the Services after the updated Privacy Policy becomes effective means the updated Privacy Policy applies to that use.
